
Laws HIPAA - Passed April 11, 2003. This law requires all healthcare information be secured. Companies that disclose information intentionally or unintentionally will be subject to fines. Illinois Public Act 094-0036 - Effective 1/1/2006 - Any "data collecting" organization, company, etc... will be required to notify effected individuals in the event of a breech of record security. FACTA - Effective 6/1/2005 - This law mandates any business that uses a "consumer report" such as a credit report to securely dispose of the information. Heavy fines will be imposed to any company violating this law GLB - Effective 11/17/1999 - This requires financial institutions to secure their clients information. Failure to comply can result in not only federal venalities but also civil liabilities. |
